Dear Truehost Executive Team,
I am writing to issue a final legal demand regarding the ongoing and egregious failures of Truehost in providing paid-for hosting services and website migration for my domains www.inquiry.org.za and www.expose.org.za. Despite repeated attempts, formal complaints, and multiple escalations, your company has failed to deliver contracted services, misrepresented capabilities, and caused substantial financial and reputational damage.
1. Summary of Issues
Email Service Failure:
Outgoing email functionality for info@inquiry.org.za and jan@inquiry.org.za remains non-functional despite repeated promises of resolution.
Incomplete Website Migration:
Migration of www.inquiry.org.za from Xneelo remains incomplete, with your system misclassifying the domain as an “addon,” blocking proper access without additional charges.
Misleading Package Advertising:
WebHosting Pro Package advertised as hosting 30 websites and unlimited email accounts. Truehost has prevented hosting of www.expose.org.za on the same plan, violating contractual terms and consumer protection laws.
Negligent and Automated Support:
AI-based support and delayed human escalation have failed to resolve urgent matters, resulting in financial and reputational harm.
Developer Advisory on Compromised Site:
A professional developer has advised that compromised sites require either restoration from healthy backups or a complete rebuild to secure and restore full functionality. Truehost has failed to implement either solution.
Unsubstantiated Suspension and Hacking Incident:
Your company has suspended my websites under the false claim of causing spam, which is a blatant misrepresentation. Upon consulting a reputable web developer in South Africa, it was discovered that the websites had been hacked, compromising their security and functionality. This breach occurred despite your assurances of providing adequate security measures, which you have failed to deliver.
2. Formal Demands
I demand that Truehost take the following actions within 4 hours of receipt:
- Immediate restoration of full email functionality for all accounts associated with www.inquiry.org.zaand www.expose.org.za.
- Complete migration and restoration of www.inquiry.org.za with confirmation that no data or content has been lost.
- Written confirmation from senior executives acknowledging remedial actions taken, compliance with the WebHosting Pro package, and assurance of uninterrupted service.
- Written assurance that hosting of www.expose.org.za under the same package is permitted.
- Immediate implementation of one of the developer-advised solutions to secure and restore compromised websites.
3. Consequences of Non-Compliance
If Truehost fails to comply within the above timeframe, I will:
- File formal complaints with the Communications Authority of Kenya (CAK) at info@ca.go.ke.
- Lodge a complaint with the Competition Authority of Kenya (CAK) at complain@cak.go.ke.
- Report the issue to the Consumers Federation of Kenya (COFEK) at hotline@cofek.africa.
- Seek arbitration through the Nairobi Centre for International Arbitration (NCIA) at info@ncia.or.ke.
- Initiate legal proceedings for breach of contract, misrepresentation, and recovery of financial losses.
- Publicly expose Truehost’s failure to deliver services using my platform www.expose.org.za, with full evidence including emails, invoices, and technical logs.
4. Legal Grounds
- Breach of Contract: Paid-for services were not delivered as agreed.
- Misrepresentation / Negligent Misstatement:Promises regarding migration, hosting capacity, and email functionality were false or misleading.
- Consumer Protection Act 68 of 2008 (South Africa): Sections 40 and 41 prohibit false, misleading, or deceptive representations.
- Negligence: Failure to act with reasonable care and skill in delivering hosting services and technical support.
5. Supporting Evidence
- Complete email trails from 05–14 August 2025.
- Paid invoices #51006 and #51007 (R140.00).
- Ticket logs, screenshots, and technical correspondence confirming failed services.
- Developer’s report detailing the hacking incident and compromised security.
6. Reservation of Rights
All rights are expressly reserved. Should Truehost fail to comply or cause further financial or reputational harm, I will pursue full legal recourse, including damages, legal costs, and any consequential losses.
This letter constitutes the final demand. Any automated, irrelevant, or evasive responses will be ignored, and legal proceedings will begin without further notice.
