Complaint about Housing Finance Kisumu branch on mishandling of a consumer loan

I write to formally and urgently lodge a complaint against HFC Bank – Kisumu Branch, regarding the manner in which my business loan application was handled, processed, classified, and disbursed. The transaction in question is under the following references:

The issues highlighted herein point to gross institutional negligence, misrepresentation, potential fraud, and a serious violation of consumer and constitutional rights. I request immediate intervention and investigation from all concerned authorities and stakeholders.

Background 

On or around 25th February 2025, I was approached by a representative from HFC Bank – Kisumu Branch regarding the possibility of securing a business loan to support and expand my ongoing commercial enterprise. Following this interaction:

I was visited at my business premises by bank representatives. I submitted all required documentation as per the bank’s standard business loan application procedures. I was not seeking a mortgage facility, nor was there any discussion or consent given towards any property-related credit arrangement.

I relied on the professionalism and fiduciary integrity of the bank’s officers to ensure accurate processing of my request and full disclosure throughout.

Issues Identified

Despite multiple follow-ups and requests for clarity throughout the loan process, the following serious irregularities were identified:

Key documents submitted and signed were either misfiled, altered, or not properly disclosed to me during or after signing.

Bank officials rushed the signing process, provided no adequate explanation of the loan structure, and I was coerced into executing paperwork without being informed of its legal implications.

The loan, initially discussed and applied for as a business loan, was unilaterally classified as a mortgage facility — a facility I neither applied for nor understood I was entering into.

Despite my continuous efforts to request full documentation, I have not been provided with a certified copy of the final loan agreement, disbursement schedule, or proof of fund release.

Funds were disbursed without my final approval, confirmation, or notification. To date, I have not received the funds personally nor through any business account under my control.

There was a clear breach of consumer rights, and the process lacked transparency, informed consent, and legal clarity. My right to financial protection and fair contractual engagement has been violated.
