Kenya’s New Gambling Bill: A Game-Changer or a Game-Stopper?

Kenya is on the verge of the biggest shake-up in its gambling industry in decades.

The Gambling Control Bill, 2023, passed by the National Assembly and awaiting presidential assent, promises to transform betting from a loosely regulated gold rush into a tightly policed industry—with teeth.

At the heart of the Bill is a new Gambling Regulatory Authority, replacing the outdated Betting Control and Licensing Board (BCLB).

Its expanded mandate includes oversight of online betting, casinos, lotteries, prize competitions, and even amusement machines.

A newly created Gambling Appeals Committee also ensures swift dispute resolution, something long overdue in this murky space.

Entry into the industry will now require deep pockets and local ties.

Online operators must deposit a hefty KSh 200 million, while physical casinos and betting shops will need KSh 20 million.

In a bid to protect national interests, at least 30% of ownership must be Kenyan, and all transactions routed through local banks.

Taxation is no longer a soft touch. A new 15% tax on gross gaming revenue replaces the old excise tax regime, with additional levies likely imposed at the county level.

Operators are also required to submit taxes by the 20th of every month, or risk stiff penalties.

More importantly, the Bill tackles gambling addiction head-on. Operators must now verify users through ID and live selfie technology, offer self-exclusion tools, and fund addiction recovery programs.

Advertising is being choked too—no gambling ads between 6 a.m. and 10 p.m., and no glitzy influencer campaigns.

Every ad must dedicate 20% of its space to responsible gambling messages.

Offenders beware: unlicensed betting can attract fines up to KSh 3 million or three years in jail.

Repeat offences come with stiffer penalties. And no more hidden operations—the Bill empowers multi-agency crackdowns led by BCLB, KFCB, CA, DCI, and others.

In short, the days of wild-west betting are over. Kenya’s new gambling law is not just about regulation—it’s about reclaiming control, safeguarding society, and taxing the billion-shilling beast the right way.

For players, operators, and regulators alike: it’s time to ante up—or fold.
