The rights Article 46 of the Constitution gives every consumer, the statutes that give them effect, and where to go next.
Article 46 of the Constitution gives every Kenyan consumer four enforceable rights. Knowing them is only half of it — this is the action each one supports.
What you buy must work, last a reasonable time and match how it was described. A product that fails early is a quality failure, not bad luck.
Do thisKeep the receipt and packaging, and put the complaint to the seller in writing within a reasonable time.
Price, terms, charges, risks and limitations must be disclosed before you commit — not buried after. This is the right most often breached.
Do thisAsk for the total cost in writing. If a charge was never disclosed, say so explicitly in your complaint.
Goods must be safe to use as intended. Unsafe or counterfeit products are a safety matter, and the Federation treats them as urgent.
Do thisStop using the product, photograph the batch or serial number, and report it to the alerts desk.
Where a defective product or poor service caused you loss, you are entitled to redress — repair, replacement, refund or compensation.
Do thisQuantify the loss with documents. A specific figure supported by evidence is far harder to refuse.

Kenya’s framework sets high thresholds for consumer protection in all spheres, and binds both the private and public sector. These are the instruments that matter most.
The Federation’s mandate
Gives consumers the right to goods and services of reasonable quality, to the information necessary to gain full benefit from them, to protection of their health, safety and economic interests, and to compensation for loss or injury.
The principal statute on unfair practices, disclosure, unconscionable representations and consumer agreements.
Prohibits false or misleading representations, unconscionable conduct and the supply of unsafe goods, and establishes the consumer protection mandate of the Competition Authority.
Provides for the standardisation of commodities and the enforcement powers of the Kenya Bureau of Standards.
Prohibits trade in counterfeit goods and establishes the Anti-Counterfeit Authority and its enforcement powers.
Governs the collection and processing of personal data, including the consent obligations relevant to lending and marketing.
